• You may not use Formarama for any unlawful practice, obscene, offensive, or pornographic content.
• You agree that Formarama may notify you by email when a submission to an event of which you are the owner, brings you over your eligible database quota.

Terms of use

Formarama acts as a neutral provider of web based database services to the global Internet. Formarama may suspend services provided to you or cancel your account without prior notice and without any refunds of unused service fees if determined that you have violated Formarama policies.

1. You use  Formarama at your own risk. Formarama will not be liable for any damages that may arise from the use of Formarama. Nor are we liable for any malfunctions or disruptions in service.
2. Formarama is a service for any individual or organization that wants to add forms to their web pages. Please do not abuse this service or use it in any way other than for the intended purpose.
3. Formarama may not be used for any unlawful activities, by sites that intentionally violate copyright laws, such as warez sites, or by any web sites that promote or endorse hatred or racism.
4. You agree that Formarama may notify you by email when a submission to an event of which you are the owner, brings you over your eligible database quota.
5. Formarama is not a secure form processor. You may not mislead your Web site visitors by telling them that they are submitting a form on a secure server.
6. We reserve the right to cut off service to any website that is found to be in violation of the terms of use.
7. Formarama reserves the right to modify Formarama at any time. Future changes could impact the way your forms function. 
   

LAWFUL PURPOSE

Formarama may refuse service to anyone. You may use Formarama services only for lawful purposes. You may not transmit any materials that are in violation of any Federal, State or Local laws. You may not transmit any copyrighted materials, material protected by trade secrets, and obscene, offensive, or pornographic content. Formarama will make the decision as to whether materials violate its policies.

PAYMENT POLICIES

Formarama will notify you by email if the initial charge to your card is declined. A second attempt to bill the card will be made in three days. If the card is again declined and you have not provided alternate valid credit card information, Formarama will cancel your order. Please note that services will not be activated until payment is received.

Recurring Charges

You must pay for your service in the first week of each billing cycle. Your account will be suspended or limited to the privileges of a free account if no payment is received by that time. Formarama will notify you by email if your account is expiring.

CANCELLATION

Formarama reserves the right to cancel your service at any time. Upon cancellation, Formarama will refund any unused amounts that you have paid. If your account is cancelled because you have violated Formarama usage policies, no refund will be paid.

PRICING POLICY

Formarama will not change your fees during the middle of your billing cycle. If fees change, they will go into effect the first day of your next billing cycle.

If you signed up for Formarama under a special promotion and you change your services, the special promotion pricing will no longer be valid for your new services.

Formarama may change package features and specifications at its discretion.

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold Formarama harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Formarama, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Formarama against liabilities arising out of any injury to person or property caused by any use of  Formarama's services.

DISCLAIMER

Formarama will not be responsible for any damages customers or their enterprises may suffer. Formarama makes no warranties of any kind, expressed or implied for services we provide. Formarama disclaims any warranty, merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-any and all service interruptions caused by Formarama and its employees. Formarama reserves the right to revise its policies at any time.

LIMITATION OF LIABILITY

In no event shall Formarama be liable to customer for any damages resulting from, or related to, any failure or delay of Formarama in providing use of the service under this agreement. Formarama makes no warranties of any kind, expressed or implied for services we provide. Formarama disclaims any warranty, merchantability or fitness for a particular purpose. In no event shall Formarama be liable to customer for any indirect, special or consequential damages or lost profits arising out of or related to this agreement, the performance or breach thereof, or the accuracy or correctness of databases or the information contained therein, even if Formarama has been advised of the possibility thereof. Any claim or legal action arising out of failure, malfunction or defects in Formarama services or goods, or arising from this contract in any respect, shall be brought within a period of one (1) year following the occurrence or said claim shall be deemed waived. Formarama’s liability to customer hereunder, if any, shall in no event exceed the total amount customer paid to Formarama hereunder. Formarama will not be responsible for any damages suffered by customer in any way related to this agreement. This includes loss of data resulting from delays, non-deliveries, wrong deliveries, and any and all service interruptions caused by Formarama and its employees by its own negligence or customers errors or omissions. Formarama reserves the right to revise its policies at any time.
